Respecting Your Privacy

  1. Cya On The Road Pty Ltd (ABN 91 636 598 706) (We, Us or Our) respects your privacy. This privacy policy sets out how We collect, hold, use and disclose your personal information.
  2. To become a subscribed user of Cya On The Road (Platform), you are required to accept that your personal information will be collected, held, used and disclosed by Us in accordance with this policy. We will ask you to consent to such collection, holding, use and disclosure of your personal information by clicking on the relevant button, link or checkbox in Our registration form. Without your consent, Our ability to provide services through the Platform will be limited.
  3. We may amend this policy from time to time, and the amended policy will be published on Our Website at https://www.cyaontheroad.com. We will notify you by email when there is an update to Our privacy policy where you will have an option to either accept or reject the updated privacy policy. If you choose to reject the updated privacy policy, Our ability to provide the services to you through the Platform will become limited.

Collection

  1. The personal information We collect and hold about you will depend on the nature of your interaction with Us, including whether you are a non-subscribed user, a subscribed user (Subscribed User) or a Subscribed User with a right to create, publish and sell itineraries (Creator). Unless you become a Subscribed User or Creator, We do not collect information that identifies you personally.
  2. A Subscribed User is able to view, save, share, use, purchase and otherwise interact with the itineraries on Our Platform.
  3. A Creator has full access to additional functionalities including the ability to:
  1. create, publish, update and sell itineraries through the Platform;
  2. upload and share photographs, and text through the Platform; and
  3. post links to third-party services (e.g. booking service).
  1. The personal information We collect from Subscribed Users and Creators will generally include:
  1. first and last names;
  2. their email address;
  3. user generated content (e.g. photographs and text) uploaded by the Creator, which may contain personal information;
  4. IP address; and
  5. information obtained through cookies and scripts such as the user’s activities on the Platform and preferences.
  1. Generally, We collect personal information directly from you. This may occur in a number of ways, including:
  1. when you sign up to become a Subscribed User or a Creator;
  2. when you are logged in as a Subscribed User or a Creator on Our Platform; or
  3. when you send Us an enquiry or provide feedback to Us, for example, through the Platform itself or via email.
  1. If you choose to log in using your Google, Facebook or Apple user account, We will collect your first name, last name, email address and your user ID from them.
  2. Any third-party services We provide to you through the Platform may require collection of your personal information (e.g. location data). The relevant third-party will collect, hold, use or disclose your personal information in accordance with its own privacy policy. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.
  3. We use a third party payment service provider that processes payments to and from Our users (Payment Service Provider). The Payment Service Provider will collect your personal information (e.g. credit card or bank account details) and share certain de-identified information with Us (e.g. last 4 digits of your credit card, card type and the country in which the card was issued) in accordance with its privacy policy.

Your Online Activity

  1. The Platform uses cookies and scripts to track your usage of the Platform.
  2. You can always disable the tracking by changing the security settings of your device. Just bear in mind that this may affect how some items are displayed on the Platform.
  3. The Platform may collect, use and/or share your location data so as to provide you with location-based services. Please be aware that your location data may only be tracked through an opt-in process and that most mobile devices will notify you of this. No location data will be collected without your authorisation being provided.

Providing Personal Information of Others to Us

  1. You must not provide Us with personal information about any other individual unless you have the express consent of that individual to do so. If you do provide Us with such information, before doing so, you:
  1. must tell that individual that you will be providing their information to Us and that We will handle their information in accordance with this privacy policy;
  2. must provide that individual with a copy of (or refer them to) this privacy policy; and
  3. warrant that you have that individual’s consent to provide their information to Us.

Use of Your Personal Information

  1. We use the personal information We collect for the purposes for which it is collected and for other related purposes, and as permitted or required by law. Our general purposes may include:
  1. to provide the services you require, and to administer and manage those services;
  2. to facilitate the creation of, and secure, your account on Our Platform;
  3. to verify your credentials;
  4. to display any text, photographs, itineraries and other user generated content uploaded by you;
  5. to respond to your enquiries or requests for assistance from Us;
  6. to provide information to you about improved or additional services that might be of interest to you;
  7. to send you administrative e-mail notifications, such as security or support and maintenance notices, or to inform you when Our terms of use or any of Our policies (including this privacy policy) have been updated;
  8. to send marketing material to you;
  9. to improve and develop the Platform, including expanding the product and service offerings available through the Platform; and
  10. otherwise to facilitate Our business operations and processes.

Disclosure of Your Personal Information

  1. Generally, We will obtain consent before We disclose any personal information other than as specified in this policy. Such consent may be given expressly or it may be implied by conduct.
  2. Your personal information may be disclosed to:
  1. Our third party service providers to permit them to provide services to Us such as hosting services, provision of infrastructure, IT services (including software design, development and maintenance services), location services, maps, images, data analysis, email delivery services, customer services and other similar services;
  2. Our external advisers who have been engaged to provide Us with legal, administrative, financial, insurance, research, marketing or other services; and
  3. any other person authorised, implicitly or expressly, when the personal information is provided to or collected by Us.
  1. We may also disclose aggregated and de-identified information to third parties who may wish to advertise with Us through the Platform.
  2. We reserve the right to disclose any personal information to law enforcement or other government officials where We reasonably believe that this may be necessary or appropriate.
  3. We will never sell, trade, lease or rent your personal information to third parties.

Direct Marketing

  1. As indicated above, We may use your personal information to send you marketing material, including advertising that is customised to your interests, characteristics or general location.
  2. Opt-out: If you prefer not to receive marketing communications from Us, you can opt out by contacting us using the contact details below. For direct marketing correspondence that you receive from Us via email or other electronic means, there will be an unsubscribe button or link which you can use to manage which messages you receive from Us.

Data Security

  1. We take the security of your personal information seriously. We take reasonable steps to protect the personal information We hold against loss, unauthorised access, use, modification or disclosure, and against other misuse.
  2. Subject to paragraph 24, when no longer required or when requested by you, We will take reasonable steps to destroy, delete or permanently de-identify personal information in a secure manner.
  3. We are entitled to retain your content (including itineraries) submitted through Our Platform and continue to use that content in accordance with Our terms of use, which is available at https://www.cyaontheroad.com/terms-of-use.

Data Deletion

  1. If you wish to initiate the process of deleting your account and all of your personal information, please use the "delete account" feature within our app.

Access and Correction

  1. You may request access to the personal information We hold about you by contacting Us using the contact details below. We will process such requests within a reasonable time. If We deny an access request as permitted or required by law, We will provide reasons for doing so.
  2. We will take reasonable steps to ensure the personal information We hold about you is up to date and accurate. Please let Us know promptly if any changes are required to be made to the personal information We hold about you by contacting Us using the contact details below or updating your profile through the Platform.
  3. You may ask Us at any time to correct personal information We hold about you. On request, We will take reasonable steps to correct the information so that it is accurate, complete and up to date, or will provide reasons for not doing so.

Complaints Handling

  1. If you wish to make a complaint about a breach of this policy or the Privacy Act 1988, you can contact Us using the contact details below. You will need to provide sufficient details regarding your complaint, together with supporting evidence and information. Our Privacy Officer will investigate your complaint and determine what steps We need to take to resolve your complaint. We will contact you if We require further information from you, and will notify you in writing of the outcome of Our investigation.
